By accessing and using the website concretenewport.com or by engaging Precision Newport Concrete for any concrete contracting services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our website or services. These terms apply to all visitors, leads, and clients.
Precision Newport Concrete is a concrete contracting company based in Newport, RI. We provide residential and commercial concrete services including but not limited to driveways, patios, sidewalks, foundations, retaining walls, pool decks, steps, and decorative concrete work.
All services are performed at properties located within our active service area. We reserve the right to decline any project at our sole discretion.
Written estimates are provided based on information available at the time of the site visit. An estimate is not a binding contract until both parties have signed a written agreement.
Estimates are subject to change if site conditions differ materially from what was observed during the estimate visit, if the scope of work is modified by the client, or if unforeseen conditions are discovered during the project (for example, buried infrastructure, unstable soil, or hidden structural issues).
Any changes to the agreed scope of work must be documented in a written change order signed by both parties before the additional work is performed.
Project scheduling is confirmed after a signed agreement and any required deposit are received. Scheduled start dates are subject to change due to weather conditions, material availability, or prior project delays. We will communicate any changes as promptly as possible.
If you need to cancel a scheduled project, please notify us in writing at least 48 hours before the scheduled start date. Cancellations made with less than 48 hours' notice may result in forfeiture of any deposit paid, to the extent permitted by applicable law.
We reserve the right to reschedule or suspend work due to unsafe weather conditions, including temperatures below freezing, heavy rain, or other conditions that would compromise the quality of the finished work.
Payment terms are specified in the signed project agreement. In general, a deposit is required to secure your place on the schedule, with the remaining balance due upon project completion unless otherwise agreed in writing.
Accepted payment methods are listed in your project agreement. Payments not received by the agreed due date may be subject to a late fee as specified in the agreement.
Title to any materials installed remains with Precision Newport Concrete until payment is received in full. We reserve all remedies available under Rhode Island law for non-payment of amounts due.
Where required, Precision Newport Concrete will obtain necessary building permits from the applicable municipality prior to commencing work. Permit fees, if not included in the written estimate, will be billed to the client at cost.
The client is responsible for notifying us of any easements, utility locations, underground infrastructure, or deed restrictions that may affect the project. While we coordinate utility locates through the applicable state notification service, accuracy of utility markings is not guaranteed.
Precision Newport Concrete warrants that work will be performed in a professional manner consistent with industry standards. Specific warranty terms, if any, are stated in the signed project agreement.
Concrete is a natural material subject to cracking, surface variation, and color inconsistency. Minor surface cracks, color variation, and efflorescence (a white mineral deposit that can appear on the surface) are normal characteristics of concrete and do not constitute defects.
Our warranty does not cover damage caused by: improper use or maintenance by the client, use of deicing salts or chemicals, tree root intrusion, settlement caused by soil conditions outside our control, or any cause external to our workmanship.
Except as expressly stated in the project agreement, all services are provided "as is" without additional warranties, express or implied, to the fullest extent permitted by law.
To the fullest extent permitted by applicable law, Precision Newport Concrete shall not be liable for any indirect, incidental, special, or consequential damages arising from the performance of or failure to perform services, including loss of use of property, loss of income, or any other economic loss.
Our total liability for any claim arising out of or related to a project shall not exceed the total amount paid by the client for that specific project.
The client is responsible for ensuring that the work area is accessible and clear of vehicles, furniture, equipment, and other obstructions prior to the scheduled start date. Delays caused by inaccessible work areas may result in rescheduling.
The client is responsible for disclosing any known conditions that may affect the project, including underground utilities, existing damage, or property restrictions.
In the event of a dispute arising from our services, the parties agree to first attempt resolution through good-faith negotiation. If negotiation does not resolve the dispute within 30 days, the parties agree to submit the dispute to mediation before pursuing any other legal remedy.
If mediation is unsuccessful, disputes shall be resolved through binding arbitration conducted in Newport County, Rhode Island, in accordance with applicable arbitration rules. The prevailing party may be entitled to recover reasonable attorney fees and costs as determined by the arbitrator.
These Terms and Conditions and any project agreements between you and Precision Newport Concrete are governed by the laws of the State of Rhode Island, without regard to its conflict of law provisions. Any legal proceedings not subject to arbitration shall be brought exclusively in the courts of Newport County, Rhode Island.
